Unions' Creepy Push Against Secret Ballot

The first campaign promise Barack Obama should break is to push through the Employee Free Choice Act. That harmless sounding piece of legislation would let union organizers do an end run around secret-ballot elections: Companies would have to recognize a union if most workers signed cards in support of it.

We're not children here. We know how those majorities can be reached. There's repeated harassment, bullying and more inventive tactics, such as getting workers drunk, then sliding sign-up cards under their noses. Meanwhile, any strong-armed tactics by employers can be dealt with.

Unclear is why unions even want to go there. Their decline is one reason for the falling fortunes of American workers, particularly those without college educations. Unions have an interesting product to sell. Surely, they can persuade workers to support them in the privacy of a voting booth. That's how Obama and the enhanced Democratic majority in Congress got where they are.

Former Democratic presidential nominee George McGovern, a pro-labor liberal, has come out against the so-called card-check provision. He calls it "disturbing and undemocratic."

This may sound obvious, but friends of labor should want what's good for laborers. Some of the best companies to work for — Whole Foods, for example — are not unionized. Such employers offer superior pay and benefits precisely to keep their workers happy and not eager to organize. They worry that unions would reduce their flexibility in managing labor.

What's wrong with letting companies that do not want to be unionized compete for the workers' affections? If the employees don't get an acceptable deal, then they will join a union. The notion that they wouldn't vote their interests in a secret ballot makes zero sense.

Your writer has belonged to several unions — the Teamsters and two Newspaper Guild chapters.

To her, the unions have giveth, and they have taketh. Thanks to them, her pay was often better than it would have been otherwise. But at times, the union work rules hindered career advancement. And let's face it: A good part of union dues goes to the administrators' own compensation and junkets.

Some of my union officials had watched too many B-movies. That would explain the occasionally dismissive or threatening lines with which they addressed the rank and file. A threat was once directed at me on the first day of the job. Actually, it was more of a pre-emptive warning, lest I "ever, ever" go over the shop steward's head — something that had never, never occurred to me. (You can guess which union that was.)

The point is that while unions are often good for employees, they're not always. We shouldn't start with the assumption that a unionized workplace is better than a non-unionized one. The secret ballot lets workers make that judgment without an organizer (or company official) breathing down their necks.

The argument for private voting is evident, which may be why supporters of the Employee Free Choice Act spend so much time vilifying its opponents — the Chamber of Commerce, Wal-Mart, even McGovern — rather than explaining its merits.

With Democrats ascendant in Washington, labor leaders will have ample opportunity to fight the Chamber. And I hope they unionize the daylights out of Wal-Mart the fair, old-fashioned way. But they should leave the brave McGovern alone.

Whatever a new President Obama and his supercharged Democratic majorities owe labor can be paid in other ways. The ridiculously named Employee Free Choice Act really is disturbing and undemocratic — and can be easily caricatured as such by the Republican opposition. It is also bad PR for unions. If they have so much to offer, why are they afraid of a secret ballot?

Ma'am;... The cause of the union which is very often the cause of workers and the country is better served by an open caucus rather than an election... There is a reason why unions are not too popular with working people, and it is that every effective tool they had for negotiating a labor agreement that was fair to both business and worker was taken from them as contrary to property rights... If you cannot deliver fair wages or fair working condition; for what should anyone pay dues??? What I would like to see is no labor unions at all... Put labor leaders in concentration camps like hitler did... And here is why: It is the task of government to seek justice, and general welfare, and tranquility, and union; and if property rights conflict with these goals then it should be property rights which must be modified...We pay taxes for the good and clear goals of government. To force workers to pay twice for the same bill of goods is pushing the limits of credibility.... It is our right to see the government do exactly that which the unions do, and not alone for union workers, but for all workers... The unions are blamed for the ruination of this land... How can an extremely small percentage of around ten percent of the population have any effect on the economy??? The problem is that those with the protection for their property rights long ago passed the price for enforcement onto labor... Labor pays the bulk of taxes in this land and creates all the value to see their rights not enforced not at all... If Government would surrender any pretense to being a fair dealer, of being our union, and of demanding our rights be respected, and only honestly tells the people that not a single right they pay for will be delivered; then we could get about the business of reforming our government from scratch, and the economy too... For the unions to try to do the job that government has committed to do, and will not do, and against the will of the government, and against the threats and propaganda of the business class -it is an invitation to ridicule... The people should not do the job of government because government refuses its job...Rather, they should replace the government... Paying twice for the same nothing is insane. Get your liberty and justice for all from your government or let it die... Liberty and justice are not goals we can reach half way by half measures..We need it all.. Half ways fixed is still broke!.. If you would think for a moment.. When Lincoln gave his famous speech about a house divided he was talking about an irrepressible conflict between property rights and human rights.. That conflict is not resolved and will only be resolved when it is resolved for good and all ...Thanks...Sweeney ...P.S... I am not saying that people should not organize a new government within the skin of the old... If they must give to the old government all the old government demands, yet deny it their faith, it will be as dead as it is rotten. We may see our government fail for us in very short order because it will not survive bankruptcy... If there will be a ruined economy every community will survive which can provide best for its members... Do not believe the government will survive all... Instead govern yourself, consider your resources as measured against your needs...Thanks..

I would just like to ask you if you have ever worked on an organizing campaign? A campaign where the employees are locked in rooms while the company forces them to listen to anti union propaganda. A campaign where the employees are threatened for just talking with the union. A campaign where the employee is so scared to be seen with the union that they will eat in a bathroom to keep from this happening. I strongly feel people have the right to choose. the right to choose many things, among them the right to choose whether or not they want to be a part of the union. What are companied afraid of? Are they afraid that if given a choice their employees would choose to have some security in their job? Are they afraid that thier employees may want a since of fairness? I was very appalled with this article and feel that people like you should research what you are talking about before you spread this tuff around. You say you have been part of a few unions, have you ever been there at the beginning of a union? Been through the struggles the employees go through to get a union in? Try it, it is a lot harder than you seem to think it is.

this is typical propaganda from the corperate greedy, its not a secret ballot if your company threatons you, that if your seen talking to or even listening to unions, your fired, this may not be legal but is the practie they use. What are they afraid of is my question exactly, having as the author of this story has said been in a union, myself, The wasted union dues are the money used for strike funds, you don't want to talk about, supporting the inter structure of the union, they have employeees too, you don't want to talk about, any legal fee's to protect the emplyoees. renting of facilities for meetings, telling only one side of the story shows the republican greedy agains lack for real free choice, which is the joke here, you can put all the lipstick on it you want but a pig is still a pig, when companys want you to think they have your best interest in mind, just take a look back in hisory at the truths, How many unions have killed theyre brothers and sisters just to make profit, none, how many corperations have, plenty, so many its hard to count the numerous deaths, and they are still climbing, why because its cheaper to kill some of us than to fix the problem, so they run the risk at our expence, remember people had companys really honored theyre workers than why did the unions get organized anyways, read the history and the corperate greedy's true colors fall thru, the bulllying and threats started when company's hired proffesional gun slinggers to ruff up anyone trying to join or form a union, Children used to work in the factories, at unbelieveable wages, we would now call slaves, thats what the real truth is, the corperate greedy want us slaving our every breath to thier liking and when we get sick, hire another in your spot, and let you die. no remorse whatsoever, anyone fighting this is the real unamericans , most have never served one day for thier country, but useing someone elses cloak of bravery to hide behind, And now the greedy corperate idiots want us to beleive the poor got us here, But I don't recall any owning more than cardboard boxes to live in, someone please tell me which of these banks the poor ran, none to my recalection, the false republican chant that the dems, loaned out all the money to buy a home is not cutting it. unless all the banks are democrats, which they aren't, so stop the smoke blowing up our rears like you have to the religous sect for 8 years now and bend over, for its our time to shove it were the sun don't shine, thanks to the idoits that run the republican party, and I hope they run the dingbat palin again, what a weaner, of course it was hard to stoop that low in the IQ department to find someone dumb enought to run. Hence Mcains runnning so none of the other rich hogs had to blow their money. and now the no new taxes thing on the 15, this shows the true colors of some, unamerican idoits, no new taxes is bush strategy all over again, we voted to abolish, they just don't get it, which is what has got us to were we are.

just to put this in simple terms so all the repugnant cons can understand, In the free elections that we take part in you get to hear the partys of both sides and independents side, and listen to them debate, and then make ones choice of who they like and vote for, but when the unions try this, they are forced to stand on public property, usually way out back away from the main entrance, the employee is told if they are seen having anything to do with the unions they will be fired, and not allowed to hear both sides of the issue, If this is what they deem real democracy then thats why the employees see it as not a real free choice election, but a forced corperate greed propaganda machine, WHAT ARE THEY AFRAID OF IS THE REAL QUESTION, but of course they don't want you to think for yourself, but for the sake of the corperate greedy. Free choise us not what they seek, and attacking your free choice is what this is all about, the free choice they speek of is one sided, thiers
