I'd like to believe it's the arrival of spring or maybe just the general decline in civility and common sense that seems to always be in the air in Washington. But it's hard to avoid the conclusion that the reaction to the nomination of Elena Kagan to the U.S. Supreme Court has been a study in the sex discrimination that she has spent her career beating back.

Enough with the pictures, already. What difference does it make if she is photogenic? Is Anthony Kennedy photogenic? Does Samuel Alito have style?

Enough with the innuendo and the denials of the hints about her sexuality — the suggestion and then denial that her stance with a bat and ball proves something other than that she likes to hit long and hard.

David Souter lived with his mother. Hello. He was a fine justice. Did we test him on the dance floor or look for pictures of him going to the opera? Who knows, and who cares?

It's absurd, and it's insulting.

It's desperate, and it's hypocritical.

Politics is full of closeted individuals, including Republicans who vote consistently against equal rights for people who share their sexual orientation, claiming that they're serving the will of their constituents, not to mention protecting their seats. Only this year, a prominent Republican California state senator was forced to "come out" after years of voting against equal rights when he was stopped for DUI after spending the evening in a gay bar.

I wish we lived in a world in which public officials felt free to sleep with whomever they wanted without fear of being judged by the media or their constituents on that basis.

But campaigns of innuendo are beneath the dignity of us all.

I don't care about Elena Kagan's private life.

That's why it's called private. No one has suggested that she has ever done anything in her life that could compromise her fitness to sit on the court, raise questions about her judgment or make her vulnerable to blackmail from enemies foreign or domestic. Indeed, she's been criticized for living too careful a life. But if she hadn't, imagine what they — whoever "they" are — would be saying about her.

Before my conservative friends jump all over me, let me be clear: I'm not making a partisan point here. Both sides, or at least both extremes, are perfectly capable of using whatever mud they can find or manufacture to defeat someone they fear will vote against them. The reason conservatives are throwing the mud this time is because they're convinced that even if Kagan isn't quite as liberal as some on my side would hope, she's not as conservative as they would prefer.

Of course she isn't. Barack Obama won the election. He is entitled to pick judges and justices who agree with him — and with the voters who put him in office. If folks don't like that, vote for someone else next time. But don't try to pillory a smart, decent and honorable woman who will be serving on this nation's high court for, God willing, many decades to come.

Ultimately, that's the end game. The mud being tossed at Kagan will not cost her confirmation. I have no doubt that this smart and, yes, very careful woman will take her place on the court. The questions are how much dirt will she have to clean off herself once she does, how much will stick however unfairly, and what message does all of this send to decent people who would like to serve their country but lack the thick skin and the perfect past to face this kind of assault.

In Kagan's case, it smacks of sexism. But men face it, too. Frankly, either way, it stinks.

Yes, there is sexism in the discussion. Since the Bork nomination, confirmation of judges has been increasingly partisan and ill-mannered. Which is to say it is rife with hypocrisy. The 'elected president should pick judges who agree with him' meme is exactly correct, but we had a different set of people saying that in the Bush years, didn't we? So the same meal which was served to the goose (by the gander) is now served to the gander, and neither side has any moral high ground on which to stand. Surely you aren't suggesting that one side operate by a more genteel (and conciliatory) set of rules than the other.
The usual petty rubbish might be drowned out by substantive debate... if the nominee had a substantive judicial record to buttress her qualifications for the highest court in the land. But she doesn't have any such record, and there is not much left to debate other than her looks and her manner. Whose fault is that?
Does the president get carte blanche? Nope, the constitution requires the Senate to advise and consent. Even presidents make booboos with SCOTUS nominations (LBJ and Bush 2 come to mind). If the nominee's thin record suggests she has more interest in legislating from the bench, or adapting the constitution rather than defending it, then both liberals and conservatives have reason to be highly skeptical.
Ms. Estrich, have you anything to say about the nominee's qualifications? Or are we content to be distracted by side issues such as 'tone of the debate' ?

It is so wonderful to see Susan sidelined to the outer rings of the political debate. She never has anything worthwhile to say. Nothing substantial. Just lefty fluff. If she had a backbone during the Clinton years instead of just kissing you_know_what she may have some credibility. But like most lefty wackos she is more concerned about the tone than the substance. That's how we got Obama.

Wonderful to watch you ride off into the sunset. I do , however, feel sorry for all the young minds you have poisoned along the way.

I believe that I can best be described as socially liberal and fiscally conservative. That may seem like a contradiction. It is not. It is like a Father that will do everything he can for his children but not to the point of bankrupting the family. Having defined my position, I would like to defend Susan's writings. I can't profess to know exactly how she thinks but I find in her columns a sense of fairness and charity. These are not Liberal or Conservative ideas. They are Human ideas. Perhaps the only thing separating us from the beasts. I may not agree with how she envisions addressing these concerns in a fiscal sense but I can't fault her compassion and fairness. Before you accuse her of being a broken record for the liberal party line, remember her defence of Sarah Palin.

Wasn't there a woman in the Bush years with "lack of judicial experience"? Harriet something or other? Was that sexism? I enjoy Ms. Estrich's articles, helps me see beyond my normal view, but agree with Bob's comment, lack of civility does cut both ways.

Susan you know this is the way the game is played now. You also know that the Democrats started this with Bork. Kagan crosses the finish line only when she is confirmed -- until then this is the process. Maybe you have past calls for civility when Mr. Roberts and Mr. Alito were up for nomination that I missed?... An aside here to other commentors... I wonder if Susan reads any comments from this particular site? I thought she might, but now I doubt it. There are a number of other sites with her articles.

It is amazing that you write only the surface issues. I do not like her radical, socialistic issues and her bond with the Obama agenda. It has nothing to do with her sexuality, appearance etc it is about her views and experience. It is hard enough to have a President who is over his head and inexperience and to have a judge??? OOPS but who needs experience when you have the goons that threaten their opposition into voting or doing what they want done. I never thought I would fear for my liberty and that I would feel sad that all the lives lost in wars to keep us free have died in vain due to the actions of one administration. Susan I have asked you many times that how can you of Jewish faith keep supporting this agenda that is so against Israel??? I ask Alan Colmes the same??? It must be the paycheck and fear too. It that is the case SHAME ON YOU!! GOD bless all of you who have sold your souls and do not fear God.
