Birthright Bigots: More Dangerous Than They Seem

They are the champions of the Constitution — at least, that's what they tell us — yet they keep looking for ways to violate it. They hold the patent on family values — at least, that's the impression they try to give — yet they believe in punishing children for the conduct of their parents. They claim to be fiscal conservatives, yet they are willing to waste millions on dead-end lawsuits. They say they are only against illegal immigrants, yet now they are waging war on U.S.-born babies.

Those who support the movement to deny citizenship to the U.S.-born children of undocumented immigrants are not only America's biggest hypocrites but also downright un-American!

On this issue, the Constitution couldn't be clearer. The 14th Amendment, ratified in 1868, says, "All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

That's it! Case closed, right?

Nah! Not if you are a xenophobia-baiting constitutional hypocrite. They are willing to bend the Constitution until it breaks, as long as they can continue to pursue their Draconian, immigrant-bashing agenda.

How else could we explain the Birthright Citizenship Act of 2011? This legislation, introduced in the House of Representatives by four Republican right-wing extremists Jan. 6 (the first day of the 112th Congress), is a blatant effort to tweak the Constitution without having to amend it!

Many pundits, Democrats and even immigrant rights advocates seem to be unaware of the real danger this bill represents. They assume — as sane people would — that a new constitutional amendment would be necessary to overturn the 14th Amendment and take away citizenship from the U.S.-born children of illegal immigrants. Thus — because that's an arduous and nearly impossible process, requiring three-quarters of the 50 states to ratify a joint resolution of Congress — they don't take the threat very seriously.

But that's not what the birthright extremists want. They want to overturn the Constitution without having to amend it — an end run around the 14th Amendment — and amazingly, they could actually get away with it!

Their game plan is to change the interpretation of "subject to the jurisdiction thereof" and use another part of the 14th Amendment to justify their Machiavellian intentions to take away the citizenship rights of U.S.-born children.

Section 5 of the 14th Amendment notes that "the Congress shall have power to enforce, by appropriate legislation, the provisions of this article," and the birthright bigots intend to use "appropriate legislation" to redefine the interpretation of "subject to the jurisdiction thereof" and make sure it excludes the U.S.-born children of undocumented immigrants — the ones they call anchor babies.

The bill notes that "a person born in the United States shall be considered 'subject to the jurisdiction' of the United States" only if at least one of the parents is a U.S.

citizen, a legal permanent resident or "an alien performing active service in the armed forces."

It would not be retroactive and would not affect the many Americans who were already born of two undocumented parents. But they will argue that from now on, illegal immigrants should somehow bequeath their illegal status to their U.S.-born children.

Isn't that special? Some Americans now are thinking of clever ways to deprive other Americans of their citizenship.

Of course, the words "subject to the jurisdiction" need no clarification because they were well-understood during the post-Civil War debate that led to the 14th Amendment. In spite of the current media-promoted myth that the amendment was meant solely to address the status of former slaves, in spite of the right-wing extremists who want us to believe it had one single purpose, the phrase "subject to the jurisdiction" also was meant to settle the status of the children of diplomats, Native Americans and former Confederate soldiers who had renounced their U.S. citizenship to serve in the Confederate army.

For practical reasons, the 14th Amendment was a "bright line" and inclusive compromise, consistent with our best American traditions.

Yet now, un-American xenophobes claim that it was only meant to affect former slaves and that our 143-year history of recognizing all U.S.-born children as Americans must be overturned.

However, they have no intentions of seeking a constitutional amendment, not when they think they can achieve the same mean-spirited objective merely by changing a statute.

The birthright citizenship bill, with 33 co-sponsors, is now in the House Judiciary Committee, where it could linger indefinitely but from where it could suddenly emerge, tucked into some huge and necessary spending bill, forcing reasonable legislators to go along with it.

Beware. Alert citizens can stop this from happening, but only if they remain vigilant of the Machiavellian maneuvers of the extreme right. This should be about Americans protecting other Americans from having their most precious constitutional right taken away by shoddy legislative tricks.

Writing an intelligent article in defense of the Mexican invasion of America requires skills beyond the scope of this “writer” who insists on the ad hominen attack, labeling his opponents, “bigots,” “fear-mongers,” “hypocrites,” “Xenophobia-baiting,” “right-wing extremist” and the like, in the hope that name-calling and stereotyping will substitute for his obvious deficiency in defense of a viable thesis.

The story of the long odyssey of Mexico to establish a Mexican lebensborn movement in America should begin and end with the Mexican Constitution itself. There is no need for Americans to consult their own Constitution, when the Mexican document is so unambiguous. Add to this the ranting of Mexican nationals and their presidents and the curious will have a complete picture of just what Mexico's intentions truly are.

Miguel Perez apparently can't get past racial identifications and so his “loyalty” to America must come under severe scrutiny, when examining any position he tends to favor.

Wrong. Mexico, “as a party to the matter” has an opinion! Mexico asserts that those children born to illegal aliens are “subject to the jurisdiction” of Mexico.

The Mexican Constitution, Chapter II, Article 30, paragraph II, states that you are a Mexican by birth, even if born on foreign territory to Mexican nationals. There you have it! Anchor Babies cannot be U.S. citizens, according to Mexican law! They are citizens of Mexico, according to the Mexican Constitution.

“Case closed.”

“Article 30 clearly and unambiguously states that they are Mexican citizens at the time of their birth – no matter where in the world that birth occurs. They are not and cannot be citizens of the United States, as they are….by the Mexican constitution….citizens of Mexico at the instance of their birth with all the rights and privileges of a Mexican Citizen. and, since we do not offer or allow the practice of 'dual citizenship,' they cannot make any claim to U.S. Citizenship.
The mere fact that they are born on U.S. soil does not, by the declaration of the Mexican Constitution make them a citizen of the USA, but rather, a citizen of Mexico. Aside from the exclusionary clause of the 14th Amendment and the Civil Rights Act of 1866….the Mexican Constitution takes precedence.”

Mexican nationals are not subject to the jurisdiction of the United States, as they repeatedly violate the laws of this country from the time they arrive here as unwanted “guests.” The Mexican crime wave in Arizona is a case in point.

The people who actually are “subject to the jurisdiction” of the United States, are forced to play hapless hosts to Mexico's obnoxious parasitic agenda, by footing the bill for the failed nation-state of Mexico.

Mexico herself has defined what is meant and Mexico "believes in" the so-called “dual citizenship,” but only insofar as it supports a strategy for the Mexican occupation army to gain a toehold in the American political process.

Citizens of the Estados Unidos Mexicanos are clearly NOT citizens of the United States of America, even if they mimic our name and attempt to “rewrite” our national anthem and manifest destiny as a people.

Americans who are resolved to end this stealth tactic of war by Mexico, need only consult the Mexican Constitution for clarification of what they already know to be true, as asserted by a long line of Mexican presidents.

Those Mexican presidents have freely acknowledged that “Wherever there is a Mexican; that is Mexico” and that the borders of Mexico “extend beyond the international boundary into American territory.”

The bill introduced by Rep. Steve King, removes the incentive for a birth tourism “industry,” predicated on squat and drop. It is designed to bring to a halt the Mexican “reconquista” of America.

The Mexican interlopers have been very foolish in boasting of how they will eclipse the white race by soaring birth rates, in their bid to absorb the self-determination and country of the American people, by systematically breeding them out of existence.

This cultural genocide against the Anglo-Saxon people, is predicated on Mexico being able to incubate its hatchlings in the American nest, as a parasitic cancer on the lifeblood of this republic.

Miguel Perez falsely asserts“…they believe in punishing children for the conduct of their parents.” This ploy points the finger of blame toward the innocent victim, while the perpetrator is supposed to get a free pass, for crying “foul,” when confronted with his criminal activity…and by the way, they are illegal alien invaders--not “undocumented immigrants.”

It is easy to understand how an enemy combatant viewpoint would regard this law to protect our nation as a “bigoted,” “mean-spirited” measure and so on, but that has absolutely no bearing on what is and what is not.

As for “shoddy legislative tricks,” the Democratic Party has been a specialist in this arena for a very long time and it is leftists and "progressive" Marxists who most typically attach an odious bill to a necessary piece of legislation, in the hope of ramming it down the collective throat of the American people.

If anyone has been “Machiavellian” in their maneuvering, it has been the left-wing extremists--including our illegal alien “president”-- who sanction the invasion of America and do everything in their power to thwart the will of the American people to secure the territorial integrity of the United States of America, including using the law--under color of authority--against the American people.

“This should be about Americans protecting other Americans from having their most precious constitutional right taken away by shoddy legislative tricks” says Miguel Perez and so it is. “Not to worry.”
