Maybe it's just a coincidence that the "Today" show and United States District Judge Joseph Tauro of Massachusetts reached essentially the same conclusion on the same day. But I'm one of those people who believe there is no such thing as a coincidence. No, I'd call it a trend in the right direction.

The "Today" show, facing protests that its "Modern Day Wedding" contest was excluding same-sex couples, decided to include them. "We're producers, not politicians," executive producer Jim Bell explained. "All we want is a good wedding."

Judge Tauro's explanation took longer, but it came to the same point. In a nice twist, Tauro hoisted states rights conservatives on their own petards, finding that the federal government had no right to limit Massachusetts' decision to treat all marriages equally by denying federal benefits to legally married same-sex couples. He then went on to hold that the federal restrictions on benefits are themselves unconstitutional because they are applied unequally.

According to Bell: "We want to be inclusive. We want to be open. We want to be fair. I'm glad we're doing the right thing." Ditto for Tauro. While constitutional law scholars were debating whether Tauro's finding that defining marriage is a state's right could be squared with his holding that the federal government violated the equal protection clause with its own definition (I think they can), the bottom line is the same.

Fairness.

There are many in the gay community who wish the gay marriage issue would go away. Of all the things to fight about, some gay friends joke. Now we can get divorced like everyone else. The only people who benefit from gay marriage, the joke goes, are the gay divorce lawyers.

More seriously, many have wondered whether taking on the sacred and at least semi-religious issue of marriage made sense when other basic issues remain unaddressed.

But you don't always get to choose your issues. Sometimes they choose you. The courts may have started the battle, in states like California and Massachusetts, but once joined, it is not going away. Even as Californians await a decision in federal court here as to the constitutionality of Prop 8 (which overturned this state's Supreme Court decision holding the prior ban on gay marriage unconstitutional), the Massachusetts decision all but ensures the issue is headed to the Supreme Court, especially if either one of Tauro's decisions is upheld.

And how will the Supreme Court vote? It depends. It depends on how the issue is framed, who is sitting in the room and how long it takes to get there.

But of this I am sure: It may be later or sooner, it may be in this term or a decade or two down the road, but there will come a day when people will look back and wonder what all the fuss was about.

Marriage, as a matter of law, is about two people making a fundamental commitment to each other, which carries with it both rights and responsibilities. Above a certain (young) age, it doesn't matter how old they are, or whether they plan to or do have children; it doesn't matter what race they are, or what religion they are — or what sex they are. All of those things may and should and do matter to the individuals making the personal decision. But like other personal decisions, they are not the business of the state.

True conservatives, and on this I am certainly one, understand that ours is a system of limited government, which protects the privacy and liberty of the individual to make his own decisions and even her own mistakes.

Marriage? It should be up to you. A good wedding is a wedding where two people love each other and commit to each other. Period.

So does this mean that a parent soon will be able to marry a child to protect an inheritance, where will the state have an interest in setting any boundaries. If two consenting adults want to marry why not three or four consenting adults.
Aren't we violating the equal protection for those that want to practice polgamy, Mormons & Muslims believe in polgamy as part of the practice of their faith. How do successfully argue for marriage as any union between consenting adults & then say no the pratice of polygamy? Inquiring minds want to know Susan.
I fear we will soon see the end of our society as we know it, I GUESS; THIS PERFECT DAY will soon me upon us. to qoute Charlie Brown, "Good Grief".

Everyone with two neurons connected knew with certainity that the DOMA when it was passed was going to be ruled unconstitutional. Now DOMA supporters need a constitutional amendment to get it right! Of course they knew it back then too.

I can't understand religious people's objection to gay marriage. If they're religious, at least in the Judeo-Christian tradition, they believe in a God who has a long history of real capability in punishing sinners. He doesn't need their help. If married gays are something He disapproves of, he can do His own smiting. He does not need to delegate smiting to self-appointed assistants.

Susan's progressive ideology has once again reared it's ugly head! Homosexuality is a sickness. It's obviously abnormal human behavior and, like other mental disease, a cure will be discovered someday. Until then let's not destroy the institution of marriage.

Susan obviously failed to mention (or just willfully ignored through a combination of stupidity, embarassment, ignorance, or many other negatively impacting states of being) that in California ALONE (yeah... super, hyper, drug commune Liberal/Progressive California) the majority voted against gay marriages. The majority in the United States don't want it. Just one lone rogue judge making a ruling (which is being appealed at this very moment, and will be overturned) doesn't reflect the desires of the nation. Just look no further than our "President." I put that in quotes because he really isn't our president, he's the president of Islam and Blacks (he hates white people just like Shabaz), lying and corrupting to get himself in office. Anyway, keep screaming that Liberal/Progressive/Moronic (or whatever they will call themselves) agenda at the top of your lungs, America is finally listening and not liking what you are saying.

I am sorry but I think you are totally wrong. Marriage is a rite, and not a right. People with cettain maladies or defiencies cannot marry, First cousins cannot marry. There are many reasons for this.

Totally destroy the meaning of marriage is totally wrong. New York once had one reason for divorice. ADULTRY. Marriage has been damaged enough already.

Marriage is a ritual blessed by God. Marriage includes a man and a woman. Again it is a rite. Don't mongrelize it.

One only has to read Susan's last few columns for the hyprocrisy of liberal positions on just about any meaningful subject to be brought to the fore. It seems that in this piece Susan is supportive of judge Tauro's position and endorsement of State's rights and finds some glee in asserting that on this matter " in a nice twist Tauro hoisted states rights conservatives on their on petards". I, a conseravtive will gladly take an upholding of Tauro's judgment by the Supreme Court if that court's ratio for upholding is the recognition once and for all of State's rights and by dint of that a confirmation of State's rights and the ninth and tenth Amendments. With that, comes the upholding of Prop 8 in Calaifornia properly voted upon by Californians, the eventual undoing of Roe v Wade and federal law endorsed abortion on demand, the undoing of the mandate to purchase healthcare insurance, and the endorsement of the rights of States to enforce federal immigration laws to name but a few consequent matters. Susan in utter and rank hyprocrisy actually states with one presumes a straight face that "True Conservatives, and on this i am certainly one, understand that ours is a system of limited government, which protects privacy and liberty of the individual..." but will at the same time endorse the greatest unconstitutional expansion and intrusion of federal government into the private lives of citizens by endorsing the Prince of Fool's healthcare debacle with its attendant fines penalties and rationing all now made certain (if it was ever in doubt ) by the Clown Prince's cowardly abuse of the recess appointment process to appointment of the redistributionist and healthcare rationist in chief Donald Berwick. Give me a break please!

I fall in the rite vs right camp.

The whole basis for desiring the "right" is for equal treatment under the law - primarily as it pertains to financial benefits. Long ago, when the federal income tax system was created it was decided that a different (lower) tax rate would be applied to married couples because they incur significnat costs in raising children that are key to the perpetuation and growth of our society. Similarly, the notion of healthcare and pension benefits offer similar quantifiable benefits to the married couple as opposed to two single individuals.

I suspect that if these particular advantages were done-away-with, then the attention and demand for non-traditional marriage would largely disappear. People could then arrange themselves in whatever living situation they desired without any bias or distortion by government regulation.

I suspect that we will soon see some polygamy-rights lawsuits, since if 2 individuals can freely select a living arrangement that is subsdized by the government, the 3 or more individuals should be allowed to receive proportional benefits. And if it is part of a religious practice, then outlawing such behavior would be a clear constitutional violation (which it probably is already).

Actually the issue will only be 3 individuals and not more as grouping in marriages of 4 or more doesn't not make sense from a tax perspective. it would only boost your income in higher tax brackets as opposed to merely pairing off in two's and threes.

But some people don't taxes affect behavior. Funny.

For the life of me I cannot understand why anyone has a problem when 2 people want to commit to a longterm exclusive relationship, regardless of gender. With today's culture of casual sex, sky high out of wedlock births, and the absense of fathers in so many childrens' lives - isn't wanting a committed relationship a good thing?!?!?

Your supposition that marriage is a "rite" and not a "right" puts government agents (i.e. JP's) is the role of promoting specific religious views. Why not separate the two completely? Everyone who wants the legal/civil benefits of marriage should register with the state. If you are religious, then you should also get married in the church of your choice. If you choose not to recognize marriage between two people of the same sex, or any divorce, you are free to join a church that agrees with you. That's fair.
