The Liberals Are Snickering

by R. Emmett Tyrrell Jr.

WASHINGTON — Is it possible that Justice David H. Souter has sensed what I have sensed in reading the liberals' dutiful adieus to him, their judicial Benedict Arnold? They all are snickering behind their hands. Sure, he pleased them enormously with his 19 years of tergiversations against conservative jurisprudence, after being President George H.W. Bush's "conservative" Supreme Court nominee. But through all Souter's years here in Washington, he revealed himself to be a stupen ...

Why is it that "quirky independence" is always against conservative values and never in favor of conservative values?

Sir;...Why not just give all the reactionaries his home adress so the first one there can take their revenge???The story I remember most about justice Souter was how hard he fought to keep the US Supreme Court from deciding an election in Florida before the people in Florida had...We all know how that quirky story turned out now, with a Court victory for the republicans being a National defeat...To me, the Law should be nonpartisan if it is to have any credibility...Forget that...Laws are made and unmade as suit the rich...The republicans have bent to every effort to make a law for the benefit of one dead person and will not help many millions of live ones..In that instance, of the law for a single person the court showed better sense than the party that spawned most of them... Usually they do not...They are all millionaires, and they support the rights of millionaires... They suffer from the same ideologies as their class, and the same inability to see through the form of law...It is not enough to have the form, or that the form follow the constitution, but that it work for people... As much as the right seeks laws by which a mere majority can remove any minority from their rights, this does not help law to work, and does not bring liberty our unity...The court would do the people a service if they told them the limits of law...No law is law that does not serve justice...The object of law is the protection of rights, which, naturally are rights...Too often the court and the laws protect wrong, and when it does so on a national stage it makes certain that people will lose respect for law and make their own... So, don't expect me to laugh at, or condemn poor Mr. Souter...He has fought the good fight as many there have not...The court, packed with republicans, and voting as republicans will not be able to right the course of this nation... I would not touch them with a ten foot pole..I would not touch them with surgical gloves..It is neither large enough, nor democratic enough to suit me, and there is no way lawyers should be allowed to judge the laws....People need to be able to see through the forms they are dealing with, and there is no chance of that with the court we have..No form is better than it works, and our form of law and constitution no longer works.....To hope to grasp success out of the jar of failure is madness... Perhaps that is the pain which made David so.....Thanks...Sweeney
