Sir;...When the republicans sent Mr. Thomas to the Supreme court they scord a massive coup: He was a black man for all political purposes who conceived of himself as white...He is like a black hillbilly...Usually it is important to put some one on the court who has the sense to see when the form, of law, of the economy, of the government, of the constitution is not working, and out of the desire for justice, if not out of empathy, they fix the problems of the form...I do not see that as very much possible...The formal problems, the Systemic problems, are becoming too great, and too widespread to fix one at a time...Inevitably; those who reach the Supreme Court are successful, and so, Rich....That class of rich people, who do nothing for their wealth, but hold dear their wealth has their empathy... It does not matter whether they are red, white, blue, or black... It does not matter what their religion is, or their sex, or their party... They are first of all prisoners of their form: LAW; and can only see life through that lense... It turns their heads toward the protection of the form, their privilages, and the protection of their property; but it cannot help us... Law is just another method found of denying to the many the justice they need, and desire... It is a method of exhausting their energy, and frustrating their purpose... If you read in Gullivars Travels about Law, you will see things have not much changed in the hundreds of years past... This class is like the financiers... They feed of the produce of the people, while the people starve...The people know law does not work, and they only need to communicate that fact to the government, which also does not work... The changing of one form is the changing of the other... If we think we cannot live without law we are wrong...If we think we cannot live without justice we are right... WE need justice and must demand it... Throwing a certain empathy at the people, or a race, or sex, or party affiliation at the court, and calling it Justice is farce... In the Greek Supreme Court the ratio of judges to citizens was one to two hundred and fifty...WE cannot do as well in our most representative and democratic body; the house of representatives... WE should not forget the for democracy to succeed, it must exist; and so much of pandering to the people, of throwing them a sop of a Supreme Court Justice is an insult...Forget giving them A Justice; and give them Justice...The time for Oligarchy has passed...Let us govern ourselves, and vote those fossils out of Court who could not find the place without a driver... If the people are sovereign, we must some where have some power... Do we??? Thanks...Sweeney
