Credit Card Issuer May Be in Violation of the Law

Dear Mary: Recently I made a credit card payment on time using online bill pay but later received a late payment fee and interest charge. I complained, and it was removed, but the woman on the phone told me to pay the account five days before the due date. Why? Because they don't "process" the payments necessarily on the day they receive them, even electronically! Where in the information are we instructed to make the payment at least five days ahead to avoid fees? -- Lucy K., Tennesse ...

are credit card companies allowed to put in a disclaimer and then not follow those payment guidelines? both my Citibank and my Chase accounts have disclaimers saying they reserve the right not to accept the payment if I fail to write my account number on the check, return address on the envelope or a bunch of other ridiculous things. I can't recall if the wording specifically says they can 'refuse' the payment which means they'd have to mail it back to you or if they are saying they are saying they don't have to 'post' the payment. I may have to go find that user agreement again. But perhaps the 'refuse' is their way of seeming to get around the law? I guess I'll start sticking it to them if they try it again and remind them of the law. They didn't refuse the payment, so they have to post it.
