I am leasing a house from a company in Houston. When I took my December rent payment into the office on Dec 1st I was told that they would no longer be renting to me or be accepting my rent. They handed me a check for the return of my security deposit & the last months rent that I paid in advance. They had purchased the property from a tax sale 1.5 years ago and the bank just purchased to house back from them. In my lease it states that should this situation happen all they owed me was the return of my deposit & the last month rent payment. However,it also states they were to give a 30 day notice. Does them not accepting my rent on the 1st constitute a 30 day notice? Can I tske them to small clains court to recove any cost I incurr to move out? I had 16 months left on a two years lease. I have not heard from the new owner/bank yet, and the old company won't give me any info on the new owner. How much time do you think I have before I have to move & how can I find out who the new owner is?Bird

The state gives a right of repossession for up to 2 years on constables tax foreclosures sales for the original owner in default to get the property back. However, your lease should still be honored but the 'new' landlord (previous homeowner). but, it better you consult an attorney. you may take your landlord to small claims court and the judge may grant you some time to remain on the property. Or try calling a company like EZ Lease that is a rental guarantee company that can help you get into an apartment quick despite your current situation. you can check out their website here: www.ez-lease.net
